Ivonix Data Systems Limited (“Ivonix Data Systems”, “we”, “us”, or “our”) respects your privacy and is committed to protecting the personal data you share with us. This Privacy Policy explains what information we collect when you visit or buy from ivonix.co.ke, how we use it, who we share it with, and the rights you have over your data. It applies to all visitors and customers, and is freely available without the need to log in, sign up, or provide any personal information.

We process personal data in accordance with the Data Protection Act, 2019 of Kenya.

2. Information We Collect

We only collect information that we genuinely need in order to sell and deliver products to you. This includes:

  • Contact and delivery details: your full name, phone number, email address, delivery address, town or county, and any delivery instructions you provide.
  • Order information: the products you order, order value, order number, delivery status, and any returns or refunds linked to your order.

3. Payment Information

Orders on this website are paid on delivery, by cash or M-Pesa. Payment is made directly to our delivery agent, or at our store at the time you receive your items.

Because of this, we do not collect or store credit card, debit card, or bank account details through this website, and no card data is processed by our online checkout. If you later agree a different payment arrangement with our team, any payment details are handled directly by the relevant payment or banking provider and not stored on our website.

4. How We Use Your Information

We use your personal data to:

  • Process, confirm, pack, and deliver your orders
  • Contact you about an order, delivery, quotation, or enquiry
  • Handle returns, exchanges, refunds, and warranty claims
  • Issue invoices and receipts and keep proper business records
  • Provide customer support and respond to your questions
  • Maintain the security of our website and prevent fraud or abuse
  • Meet our legal, tax, and accounting obligations in Kenya

We do not sell, rent, or trade your personal data to any third party for marketing purposes.

5. Legal Basis for Processing

Under the Data Protection Act, 2019, we process your personal data on the following bases:

  • Performance of a contract — to fulfil the order you placed with us.
  • Legal obligation — to keep tax, VAT, and accounting records as required by Kenyan law.
  • Legitimate interest — to secure our website, prevent fraud, and improve our service.
  • Consent — where you have opted in, for example to receive offers or updates from us. You may withdraw consent at any time.

6. Cookies

Our website uses cookies, which are small files stored on your device. We use them to:

  • Remember the items in your shopping cart as you browse
  • Keep you signed in if you have an account
  • Remember your preferences, such as recently viewed or compared products
  • Understand how visitors use our site so we can improve it

Most cookies we use are essential to the operation of the cart and checkout. You can block or delete cookies through your browser settings, but please note that the cart and checkout may not work correctly if essential cookies are disabled.

7. Who We Share Your Information With

We share personal data only where it is necessary, and only with parties who are required to keep it confidential:

  • Delivery partners — couriers, riders, and transport providers receive your name, phone number, and delivery address so that they can deliver your order.
  • Service providers — our web hosting provider and technical support providers, who store and maintain the website on our behalf.
  • Professional advisers — our accountants or auditors, where required for tax and record-keeping purposes.
  • Government or regulatory authorities — where we are required to disclose information by law, court order, or lawful request.

8. Data Retention

We keep your personal data only for as long as it is needed for the purpose it was collected. Order, invoice, and tax records are retained for the period required by Kenyan tax and accounting law. Enquiries and general correspondence are kept only as long as reasonably necessary. When data is no longer needed, it is securely deleted or anonymised.

9. Your Rights

Under the Data Protection Act, 2019, you have the right to:

  • Be informed about how your personal data is being used
  • Access the personal data we hold about you
  • Request correction of data that is inaccurate, outdated, or incomplete
  • Request deletion of your data, where we are not required by law to keep it
  • Object to or request that we restrict certain processing of your data
  • Withdraw your consent at any time, where processing is based on consent

To exercise any of these rights, contact us on +254 142 022 065 or at sales@ivonix.co.ke. We will respond within a reasonable time. If you are not satisfied with our response, you may lodge a complaint with the Office of the Data Protection Commissioner (ODPC) in Kenya.

10. Security

Our website is secured with an SSL certificate, so information passed between your browser and our site is encrypted. We also apply access controls and reasonable technical and organisational measures to protect personal data against loss, misuse, or unauthorised access. However, no method of transmission over the internet is completely secure, and we cannot guarantee absolute security.

11. Children

Our website and products are intended for adults. We do not knowingly collect personal data from children. If you believe a child has provided us with personal data, please contact us and we will delete it.
